International application
Hungarian applicants may file international design applications both at the Hungarian Intellectual Property Office (hereinafter
referred to as the "HIPO") and at the International Bureau based in Geneva. If the application is filed with the HIPO, the
HIPO notifies the applicant of the fact and date of filing and forwards the application to the International Bureau. The fact
of the forwarding will also be notified to the applicant by the HIPO. A fee of HUF 14,000, as laid down by law, shall be paid
for the forwarding. If the applicant has not paid the transmission fee, the HIPO shall invite the applicant to pay the fee.
If the application received and forwarded by the HIPO is received by the International Bureau within one month, the filing
date will be the date of filing with the HIPO.
If the HIPO transmits the application after one month or if the applicant files the application directly with the International
Bureau, the date of filing will be the date of receipt by the International Bureau.
Other countries (international application)
In order to gain a position in international markets, it is possible to file an application for international registration
with the International Bureau of the World Intellectual Property Organization (WIPO) (International Bureau) through the so-called
Hague System. International industrial design applications are governed by the Hague Agreement. Thanks to the Hague System,
protection can be obtained in several countries or regions at the same time - up to 99 countries at the same time. The use
of the Hague System makes it quicker and easier to obtain protection in different countries around the world, often saving
significant translation costs for applicants who choose to register internationally. The system also provides significant
procedural and administrative ease in the process of obtaining protection in multiple countries.
International applications are examined for formal requirements by the WIPO International Bureau and published in its official
journal, the International Design Bulletin. Subsequently, the offices of the Member States or regions designated in the application
(e.g. the European Union Intellectual Property Office (EUIPO) or the Benelux Intellectual Property Office (BOIP)) will further
examine the application according to the same requirements as those applied for directly.
Applicants domiciled or resident in Hungary may also file an international application at the Hungarian Intellectual Property
Office. The HIPO will forward the application to the International Bureau upon payment of a fee of HUF 14,000. An international
application may also be filed directly with the WIPO International Bureau.
